General Terms and Conditions (GTC)

1. Scope & Contracting Parties

These General Terms and Conditions (GTC) apply to all contracts for the purchase and provision of eSIM data plans concluded between Airnetly and the customer. The contract is concluded with:

Any differing terms and conditions of the customer will not be recognized unless we expressly agree to their validity in writing.

2. Conclusion of the contract

• The presentation of eSIM tariffs on our website does not constitute a binding offer, but rather an invitation to place an order.
• By clicking the "Buy" or "Checkout" button, you are placing a binding order for the services in your shopping cart.
• The contract only comes into effect upon our acceptance of your order (order confirmation via email).

3. eSIM Performance & Activation

• Digital delivery: We deliver eSIM plans exclusively in digital form. After successful payment, you will receive the activation data (QR code or code for manual entry) via email.
• Terms of use: The available data volume and validity period depend on the selected tariff.
• Compatibility: Use requires an eSIM-enabled device. Please check your device's compatibility on our website before purchasing.

4. Prices and Payment Terms

• Small business regulation: All prices quoted are final prices. In accordance with § 19 of the German Value Added Tax Act (UStG), no VAT is charged and therefore not shown on invoices.
• Payment processing: Payment is processed through our service provider Stripe. We accept the payment methods offered there, such as credit card.
• Due date: The purchase price is due for payment immediately upon conclusion of the contract.

5. Right of withdrawal for digital content

• Cancellation period: As a consumer, you have a statutory right of cancellation within 14 days.
• Special note: For digital content (eSIM data), your right of withdrawal expires prematurely if we have begun performance of the contract after you have expressly agreed that we will begin before the end of the withdrawal period and you have confirmed that you will thereby lose your right of withdrawal (§ 356 para. 5 BGB).
• Cancellation notice: To exercise your right of cancellation, please inform us by means of a clear statement (e.g. by e-mail).

6. Disclaimer

• General liability: We are liable without limitation for intent and gross negligence, as well as for injury to life, body or health.
• Network quality: We assume no liability for network coverage, connection quality or data speeds, as these services are provided by the respective local mobile network operators.

7. Final Provisions

• Applicable law: The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
• Jurisdiction: If the customer is a merchant or a legal entity under public law, the place of jurisdiction for all disputes is Hanau. For consumers, the statutory regulations apply.
• Severability clause: Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.
